Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. El presente artículo recoge resultados de la investigación adelantada en el Estado del arte sobre la enseñanza de la historia en la educación infantil, que abarco una revisión bibliográfica de lo que circula entre los años 2006-2016 en la ciudad de Bogotá. En ella interesaba conocer las perspectivas, problemas y avances que se ubican en la formación del educador infantil, en lo que se enseña a niños y niñas sobre los aspectos temporales asociados a la iniciación del pensamiento histórico. Aquí (...) sólo presentaremos una de las categorías encontradas, que alude a las elecciones sobre el qué enseñar en la educación infantil a propósito de la historia. En este aspecto se encontraron tres asuntos que permiten generar apuestas sobre la enseñanza de la historia y del pensamiento histórico en las edades iniciales: la experiencia del tiempo en la enseñanza de la historia; el abordaje de los objetos como pretextos históricos; y la comprensión del tiempo sin aludir al contenido histórico. Although substantial evidence suggests receiving social support has positive implications for well-being, less is known about how providing support can confer benefits, particularly for Asian American and Latinx individuals who are more likely to come from interdependent cultures that emphasize family obligation. Asian American and Latinx college students reported on anxiety before taking part in a modified laboratory task that elicited a physiological stress response as measured by total cortisol output. They were randomly assigned to write a supportive note to (...) a family member, a supportive note to a close friend, or about their day in a control condition after the mild lab stressor and reported on psychosocial well-being. Those who provided support to a family member experienced higher self-esteem compared to those in the control condition. However, there was variation in Asian American and Latinx participants’ physiological stress response. The findings suggest that providing support to close others, particularly family members, can be differentially meaningful for individuals from diverse backgrounds. (shrink)

ANGIE PEPPER | : This paper attempts to bring some clarity to the debate among sentientists, biocentrists, and ecocentrists on the issue of who or what can count as a candidate recipient of justice. I begin by examining the concept of justice and argue that the character of duties and entitlements of justice sets constraints on the types of entities that can be recipients of justice. Specifically, I contend that in order to be a recipient of justice, one must (...) be the bearer of enforceable moral claim rights. I then suggest that this has important implications for the dispute among sentientists, biocentrists, and ecocentrists. In brief, I show that sentientists cannot exclude nonsentient entities from the domain of justice merely by denying that they have “the right kind of interests,” and biocentrists and ecocentrists cannot move seamlessly from some feature of living things or ecosystems to entitlements of justice. I further argue that ultimately this disagreement on the bounds of justice bottoms out in a normative disagreement about which entities possess moral claim rights, and that the case for biotic or ecosystem rights has yet to be convincingly established. | : Le présent article vise à clarifier le débat parmi sentientistes, biocentristes et écocentristes autour de la question de qui ou de ce qui peut valoir comme un récipiendaire légitime de justice. Qualitative studies on assisted reproductive technology commonly focus on the perspectives of participants living in major metropolises. In doing so, the experiences of those living outside major cities, and the unique way conditions of spatiality shape access to treatment, are elided. In this paper, we examine how location and regionality in Australia impact upon access and experience of reproductive services. We conducted twelve qualitative interviews with participants residing in regional areas across Australia. We asked participants to discuss their experience with (...) assisted reproduction services and the impacts of location on access, service choice, and experience of care, and analysed the data using reflexive thematic analysis, as outlined by Braun and Clarke (2006, 2019). Participants in this study reported that their location impacted the services available to them, required considerable time in travel, and reduced continuity of care. We draw on these responses to examine the ethical implications of uneven distribution of reproductive services in commercial healthcare settings which rely on market-based mechanisms. (shrink)

Could global government be the answer to global poverty and starvation? Cosmopolitan thinkers challenge the widely held belief that we owe more to our co-citizens than to those in other countries. This book offers a moral argument for world government, claiming that not only do we have strong obligations to people elsewhere, but that accountable integration among nation-states will help ensure that all persons can lead a decent life. Cabrera considers both the views of those political philosophers who say (...) we have much stronger obligations to help our co-citizens than foreigners and those cosmopolitans who say our duties are equally strong to each but resist restructuring. He then outlines his own position, using the European Union as a partial model for the integrated alternative and advocating instituting EU-style supranational government, development aid, and free movement of persons in the Americas and other regions. Over time, Cabrera argues that the transformation of the global system into a cohesive network of democratic institutions would help ensure that anyone born anywhere could lead a decent life. Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

In virtue of their capacity for political agency, political agents can possess special rights, powers, and responsibilities, such as rights to political participation and freedom of speech. Traditionally, political theorists have assumed that only cognitively unimpaired adult humans are political agents, and thus that only those humans can be the bearers of these rights, powers, and responsibilities. However, recent work in animal rights theory has extended the concept of political agency to nonhuman animals. In this article, I develop an account (...) of political agency that identifies the capacities that one must possess to be a political agent and captures the fact that political action is a distinctive type of action. Crucially, this account makes sense of the standard assumption that only some humans count as political agents, and explains why few nonhuman animals, human infants, and severely cognitively impaired humans are likely to possess the capacity for political agency. I go on to reject the view, recently advanced by Sue Donaldson and Will Kymlicka, that nonhuman animals can be ‘nonintentional political agents’. I conclude by suggesting that most nonhuman animals, as well as human infants and humans with severe cognitive impairments, cannot straightforwardly be assigned rights to political participation. Situations are powerful: the evidence from experimental social psychology suggests that agents are hugely influenced by the situations they find themselves in, often without their knowing it. In our paper, we evaluate how situational factors affect our reasons-responsiveness, as conceived of by John Fischer and Mark Ravizza, and, through this, how they also affect moral responsibility. We argue that the situationist experiments suggest that situational factors impair, among other things, our moderate reasons-responsiveness, which is plausibly required for moral responsibility. However, (...) even though we argue that situational factors lower the degree of our reasons-responsiveness, we propose that agents remain moderately reasons-responsive to the degree required for moral responsibility. Nonetheless, those affected by situational factors are arguably less morally responsible than those who are not subject to similar situational factors. We further evaluate an understanding of reasons-responsiveness which relativizes reasons-responsiveness to agents’ circumstances. We argue that the situationist data do not warrant this kind of divergence from Fischer’s and Ravizza’s account. We conclude by discussing what situationist experiments tell us about our relationship to non-reasons. (shrink)

Libet’s timing experiments have resulted in some strong and unsavoury claims about human agency. These range from the idea that conscious intentions are epiphenomenal to the idea that we all lack free will. In this paper, I propose a new type of response to the various sceptical conclusions about our agency occasioned by both Libet’s work and other experiments in this testing paradigm. Indeed, my argument extends to such conclusions drawn from fMRI-based prediction experiments. In what follows, I will provide (...) a brief description of these experiments, sketch arguments one may be tempted to draw on their basis, and argue that such arguments rely on a questionable premise: that experimental subjects have relevant proximal intentions. I argue that we do not intentionally and rationally shape our character and values in major ways. I base this argument on the nature of transformative experiences, that is, those experiences which are transformative from personal and epistemological points of view. The argument is roughly this. First, someone who undergoes major changes in her character or values thereby undergoes a transformative experience. Second, if she undergoes such an experience, her reasons for changing in a major way are inaccessible to her (...) beforehand. Third, if such reasons are inaccessible beforehand, she cannot act on them and thus cannot rationally and intentionally shape her character or values. All cosmopolitan approaches to global distributive justice are premised on the idea that humans are the primary units of moral concern. In this paper, I argue that neither relational nor non-relational cosmopolitans can unquestioningly assume the moral primacy of humans. Furthermore, I argue that, by their own lights, cosmopolitans must extend the scope of justice to most, if not all, nonhuman animals. To demonstrate that cosmopolitans cannot simply ‘add nonhuman animals and stir,’ I examine the cosmopolitan position developed by Martha (...) Nussbaum in Frontiers of Justice. I argue that while Nussbaum explicitly includes nonhuman animals within the scope of justice, her account is marked by an unjustifiable anthropocentric bias. I ultimately conclude that we must radically reconceptualise the primary unit of cosmopolitan moral concern to encompass most, if not all, sentient animals. (shrink)

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

In a recent article in Sociology, Diane Richardson contends that rather than focusing on theorizing the specific relationship between sexuality and gender, researchers should focus on developing frameworks that capture the complex and dynamic nature of that relationship. Towards that end, Richardson proposes ‘patterned fluidities’ as a working metaphor for feminine sexuality. This article explores the potential of the metaphor as a focal point for bringing together different strands of feminist thought on heterosexuality. It discusses if and how ‘patterned fluidities’ (...) are supported by empirical evidence and how they interact with areas of thought that do not fall within the scope of Richardson’s article, namely feminist views on postmodernity. In this paper, I offer an analysis of the radical disagreement over the adequacy of string theory. The prominence of string theory despite its notorious lack of empirical support is sometimes explained as a troubling case of science gone awry, driven largely by sociological mechanisms such as groupthink (e.g. Smolin 2006). Others, such as Dawid (2013), explain the controversy by positing a methodological revolution of sorts, according to which string theorists have quietly turned to nonempirical methods of theory assessment given (...) the technological inability to directly test the theory. The appropriate response, according to Dawid, is to acknowledge this development and widen the canons of acceptable scientific methods. As I’ll argue, however, the current situation in fundamental physics does not require either of these responses. Rather, as I’ll suggest, much of the controversy stems from a failure to properly distinguish the “context of justification” from the “context of pursuit”. Both those who accuse string theorists of betraying the scientific method and those who advocate an enlarged conception of scientific methodology objectionably conflate epistemic justification with judgements of pursuit-worthiness. Once we get clear about this distinction and about the different norms governing the two contexts, the current situation in fundamental physics becomes much less puzzling. After defending this diagnosis of the controversy, I’ll show how the argument patterns that have been posited by Dawid as constituting an emergent methodological revolution in science are better off if reworked as arguments belonging to the context of pursuit. The result of Hannah Arendt’s study of bourgeois revolutions reflects not only the contradictions and dichotomies of her thought, but is an important diagnosis of the impact of liberal policies, their contradictions and evolution within the history of democracy. Modern republicanism, although critical of liberalism, assimilated elements inherent to liberal democracy, for example, the importance of the law, always imputed based on ideological political precepts of its time. The relevance of this analysis allows us not only to understand the bases (...) of the philosopher’s political thought, but its development in what she calls: public space. This must be a place for the expression of opinions, and therefore, for Arendt, without plurality, politics and public freedom are compromised to the extent that they make it impossible to maintain a space for the realization of freedom. However, in an unequal world, who can exercise their citizenship freely in public space? Was the liberal promise capable of providing these guarantees? In dialogue with Habermas and beyond, we intend with this investigation to outline the weaknesses of a bourgeois notion of the public sphere and to enunciate the urgency of building an ideal of republicanism based on popular demands. ABSTRACT This paper discusses keys to the moral procurement, treatment and disposition of remains used for scientific research, specifically those donated to the University of Tennessee’s Anthropological Research Facility (ARF). The ARF is an outdoor laboratory dedicated to better understanding the fate of human remains in forensic contexts, and focuses its research on decomposition, time since death estimates, body location and recovery techniques, and skeletal analysis. Historically, many donations were unclaimed bodies received from medical examiners (although it will be shown (...) that this trend is changing), and it has been argued that the use of unclaimed bodies for medical or scientific purposes is a violation of autonomy since no consent was given by the individual. It is argued here, however, that the domain of autonomous choice extends to one’s own corpse only insofar as expressed wishes are made known prior to one’s death, and that in the absence of expressed intent toward final disposition, it is acceptable for institutions to receive donations from medical examiners or family members. This paper also discusses other philosophical issues related to donation, consent and autonomy, and the forensic benefits of research conducted at the Anthropological Research Facility. (shrink)

ABSTRACT This cross-sectional study compared the moral reasoning of first-year and third-year doctoral students in clinical psychology. Nineteen first-year and 20 third-year students were recruited from 17 doctoral training programs in the UK. Most adopted a sophisticated approach to moral judgments, as assessed by the Defining Issues Test, although, surprisingly, more experienced students had significantly less sophisticated schemata. In their moral judgments, less experienced students relied more heavily on their personal, and more experienced students on their professional, constructs, as assessed (...) by repertory grid technique. Nonprofit organizations (NPOs), are quite complex in terms of organizational structure, diversity at the workplace, as well as motivational mechanisms and values rationality. Nevertheless, from an Organizational Psychology perspective, the systematic analysis of this context is scarce in the literature, particularly regarding conflicts. This qualitative study analyzes types, prevalence and consequences of conflicts in a large NPO organization considering as theoretical framework several consolidated Organizational Psychology theories: Conflict Theory, Social Comparison Theory and the Equity Theory. Conflicts were analyzed taking into (...) account volunteers’ perspective, who has been consistently protagonist on NPOs research, but also considering paid staff’s perspective, as one of the main stakeholders in these organizations, whose relative power has increase in the past decade due the professionalization of the NPO’s sector. Results confirmed the existence of four types of conflicts: task, process, status and relationship conflicts. Relationship conflict is the least reported type, revealing the protection factor that values and engagement with a social aim have on this organizational context. The most relevant finding is the strong difference between paid staff and volunteers in conflict perceptions, showing paid staff, overall, higher levels of conflicts than volunteers. Findings also show stronger negative consequences for paid staff compared to volunteers. Theoretical and practical implications are discussed. (shrink)

In this paper, I defend the claim that many sentient nonhuman animals have a right to privacy. I begin by outlining the view that the human right to privacy protects our interest in shaping different kinds of relationships with one another by giving us control over how we present ourselves to others. I then draw on empirical research to show that nonhuman animals also have this interest, which grounds a right to privacy against us. Este trabajo propone explicar, a partir de la metodología propuesta por la Comisión Europea en el “Manual para la Perspectiva de género”, por qué las mujeres rurales víctimas del conflicto armado en Colombia se constituyen como un grupo especialmente vulnerabilizado y cuáles son las principales barreras a las que se enfrentan al momento de reclamar su derecho a la restitución de tierras, específicamente en los programas que se vienen desarrollando en el marco de la Ley 1448 de 2011.

In this article, I expand the existing discourse on climate justice by drawing out the implications of taking animal rights seriously in the context of human-induced climate change. More specifically, I argue that nonhuman animals are owed adaptive assistance to help them cope with the ill-effects of climate change, and I advance and defend four principles of climate justice that derive from a general duty of adaptation. Lastly, I suggest that even if one can successfully argue that the protection of (...) human interests in adaptation ought to be prioritised, nonhuman animal rights will continue to place significant constraints on climate change action. ABSTRACT This text aims to reflect on why speech genres are relevant to variation studies, especially for third wave studies, whose central issue is the notion of style. Through bibliographic research, we examine part of the literature of the third wave of variation studies and part of the literature of the Bakhtinian approach, focusing on the notion of style, to (i) highlight some connections between these approaches and to (ii) articulate them, in some other points. The results of this reflection (...) indicate that speech genres are relevant to the interests of third wave studies because (i) linguistic style is a property of speech genres, upgradeable due to the aesthetic finalizations they receive; and (ii) an understanding of style requires an understanding of the (social and formal) constitution of the genres, in which categories of analysis that are of interest to the third wave of variation studies are indicated. In this paper I set out to investigate the claim that addicts lack su cient control over their drug-taking and are thus not morally responsible for it. More speci cally, I evaluate what I call the Simply Irresistible Argument, which proceeds from the claim that addictive desires are irresistible to the conclusion that addicts are not responsible for acting on such desires. I rst propose that we have to disambiguate the notion of an irresistible desire according to temporal criteria, and (...) revise the original argument accordingly in two di erent ways; one involving proximally irresistible desires and one involving permanently irresistible desires. I propose that both versions of the Simply Irresistible Argument fail, and, as a result, that considerations about irresistible desires and control cannot extricate addicts from responsibility for their drug-taking. The Churches – seen as institutional actors of civil society – are analyzed in terms of their material and symbolic resources which may act as prerequisites for the (...) initiation or support of oppositional activities. The relation of accommodation between the Church and the Communist regimes installed in the three countries are also analysed comparatively. The analysis follows the politically significant behaviour of the three Churches and the corresponding attitudes and measures developed by the Communist authorities. The article discusses Poland as the only case where the Church has been actively involved, on multiple levels, in oppositional activities. The distinctive feature in the Polish case is given by the complex ties developed by the Church with the remaining actors of the anti-Communist opposition, as well as by the enduring presence of religious imagery within the Polish society. Hungary and Romania displayed only a modest activity in the direction of religion-based opposition, being marked by isolated acts of defiance from individual members of the clergy in the context of an overall passivity of the Churches. The empirical and theoretical resources of different disciplines are often combined to shed light on questions that concern the deep history of humanity, such as the geographic origin of people groups, patterns of migration, and the diffusion of culture. In this article, I discuss three ways in which other disciplines, such as biology and archaeology, are integrated with historical linguistics to enhance our understanding of the past. First, other disciplines provide background knowledge that helps to constrain and assess competing historical (...) explanations of the data. I examine this issue in the context of the Principle of the Common Cause and Inference to the Best Explanation. Second, the synthesis of data from multiple disciplines provides a diverse and varied set of evidence, which is epistemically superior, other things being equal, to a homogeneous set of evidence. I consider several justifications for the confirmational value of diverse evidence. Finally, methods and procedures from other disciplines can often be fruitfully applied to forge new pathways to knowledge. Here, I survey the recent application of phylogenetic methods from biology, used for inferring evolutionary trees, within historical linguistics. (shrink)

This is an exploration of women’s tradition of hospitality, the epistemic and moral contribution of their practices of welcoming the other and their historical experience as providers of care. The essay claims that female hospitality has largely consisted of care for others, which challenges a social model based on individualism and self-sufficiency. The argument is rooted in ethnography and Jewish thought and reclaims the home as an ethical space. This text analyses two disturbing and painful stories from the Tanakh that (...) are both examples of the consequences of extreme or absolute hospitality and violence against women. The famous works of Jacques Derrida and Emmanuel Lévinas on hospitality as ethics and hospitality as the feminine are discussed vis-à-vis anthropological and feminist approaches to the connection between the female welcoming of the other and the ethics of care. Finally, the reflections of the members of Beit Midrash Arevot shed light on a traditionist feminism that develops an ethics and practice of hospitality as welcoming otherness. (shrink)

The Coronavirus Disease 2019 pandemic prompted the need for a teleneuropsychology protocol for the cognitive assessment of older adults, who are at increased risk for both COVID-19 and dementia. Prior recommendations for teleneuropsychological assessment did not consider many of the unique challenges posed by COVID-19. The field is still in need of clear guidelines and standards of care for the assessment of older adults under the current circumstances. Advantages of teleneuropsychological assessment during the COVID-19 pandemic include reduced risk of contracting (...) the virus, eliminating travel time and reducing cost, and more rapid access to needed services. Challenges include disparities in technology access among patients, reduced control over the testing environment, impeded ability to make behavioral observations, and limited research on valid and reliable cognitive assessment measures. The aim of this perspective review is to propose a teleneuropsychological protocol to facilitate neuropsychological assessment utilizing a virtual platform. The proposed protocol has been successful with our clinical and research populations and may help neuropsychologists implement teleneuropsychology services without compromising validity or reliability. However, there is increasing need for research on teleneuropsychological assessment options for both clinical and research purposes. (shrink)

This article is based in a critical recognition of the determinate influence of Mary Daly's feminist ethical and theological reflection, particularly as found in her earlier work, on the development of Christian feminist theologies. It argues that the content and form of Daly's rejection of traditional religion constitute a clear alignment of feminist commitment with rejection of traditional religion that is fundamentally problematic for those advocating the possibilities of creative and liberative feminist Christian encounters. The rejection of traditional religion is (...) posited as an imperative of feminist consciousness, and as a testimony to feminist realisation. Such is the impact of Daly's critical articulation of the incompatibility of feminism and Christianity; she has influenced a dominant discourse about whether it is possible to be a Christian and a feminist. The thesis of situationism says that situational factors can exert a signi cant in uence on how we act, o en without us being consciously aware that we are so in uenced. In this paper, I examine how situational factors, or, more speci cally, our lack of conscious awareness of their in uence on our behavior, a ect di erent measures of control. I further examine how our control is a ected by the fact that situational factors also seem to (...) prevent us from becoming consciously aware of our reasons for action. I argue that such lack of conscious awareness decreases the degree of control that agents have. However, I propose that while being in uenced by situational factors in such ways may impair and diminish one’s control, it (typically) does not eradicate one’s control. I further argue that being in uenced by situational factors, in the way set out above, also decreases one’s degree of moral responsibility. (shrink)

In this paper, I argue that some intentional actions are not triggered by proximal intentions; i.e. there are actions which are intentional, but lack relevant proximal intentions in their immediate causal history. More specifically, I first introduce various properties of intentions. I then argue that some actions (such as some spontaneous actions) are triggered by mental states which lack properties typically ascribed to intentions, yet these actions are still intentional. In Just Fodder: The Ethics of Feeding Animals, Josh Milburn thinks through the implications of feeding animals by focusing on the relationships between humans and three different groups of animals: (1) animal companions; (2) animal neighbours; and (3) wild animals. In my comments, I concentrate on how the actions and agency interests of these animals problematise some of Milburn’s assumptions and normative prescriptions. My overall aim is to show how giving animal agency more prominence in our thinking about what we (...) owe to them has significant implications. It is my view that current theorising about other animals focuses too heavily on their experiential welfare and not enough on what animals do and the normative significance of what they do. Though I agree with Milburn that all animals have a right against being killed and made to suffer, a full ethical analysis of our relations with other animals must also consider their (equally weighty) interest in self-determination. In this article, I will provide a critical overview of the form of non-deductive reasoning commonly known as “Inference to the Best Explanation” (IBE). Roughly speaking, according to IBE, we ought to infer the hypothesis that provides the best explanation of our evidence. In section 2, I survey some contemporary formulations of IBE and highlight some of its putative applications. In section 3, I distinguish IBE from C.S. Peirce’s notion of abduction. After underlining some of the essential elements of IBE, (...) the rest of the entry is organized around an examination of various problems that IBE confronts, along with some extant attempts to address these problems. In section 4, I consider the question of when a fact requires an explanation, since presumably IBE applies only in cases where some explanation is called for. In section 5, I consider the difficult question of how we ought to understand IBE in light of the fact that among philosophers, there is significant disagreement about what constitutes an explanation. In section 6, I consider different strategies for justifying the truth-conduciveness of the explanatory virtues, e.g., simplicity, unification, scope, etc., criteria which play an indispensable role in any given application of IBE. In section 7, I survey some of the most recent literature on IBE, much of which consists of investigations of the status of IBE from the standpoint of the Bayesian philosophy of science. (shrink)
